White Paper: The End of Morrison?

The US Supreme Court decision in Morrison substantially curtailed the adjudication of claims made against issuers of foreign listed securities. In its wake, securities litigation burgeoned in many countries around the world, filling in the gaps caused by Morrison. However, efforts to bring claims on foreign listed securities in the United States have been made. A recent decision in a putative class action against Barclays may be another forward step in a trend of reshoring such cases in the US.

Total settlement dollars in U.S. securities-related class actions where final approval was granted in the year 2024 were down from 2023. Nonetheless, these same settlements were still an important source of recovery for investors. Indeed, in the U.S. alone, $4.75 billion was secured in securities-related class action settlements for eligible class members in 2024.

2023 delivered a banner year for investor recoveries. The $7.9 billion in settlement proceeds across the globe was the highest total in the past five years.1 Recorded settlement funds in 2023 surpassed last year’s robust year by approximately $600 million.
